By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence. We reserve the right to refuse service to anyone for any reason at any time.

3. 30-DAY DEFECT-ONLY RETURN & REFUND POLICY

We offer a 30-day return policy starting from the official delivery date of your item, strictly under the following conditions:

Eligible Returns (Defective Units Only)

  • Returns are only accepted if the mini mobile device experiences a technical malfunction, hardware failure, or factory defect within 30 days of delivery.

  • You must notify our customer support team at Kidyphone.contact@gmail.com within this 30-day window with proof of purchase and video/photo evidence of the malfunction.

Non-Eligible Returns (Exclusions)

To maintain competitive pricing and high standards, we do not accept returns or issue refunds under the following circumstances:

  • Buyer's Remorse / Unwrapped Products: Returns are not accepted if you simply change your mind, no longer want the device, or if the product has been unboxed/unwrapped and functions normally.

  • Accidental Damage / Misuse: We do not cover damage caused by drops, liquid exposure, physical abuse, unauthorized modifications, software tampering, or general wear and tear caused by the customer.

  • Incorrect Orders: Items ordered incorrectly by the customer (e.g., wrong color or model) are not eligible for return once shipped.

4. SHIPPING POLICY & COSTS

  • Free Shipping: Standard shipping is provided free of charge to eligible regions (including the United States, United Kingdom, Canada, Australia, Switzerland, Germany, and other supported countries), unless explicitly notified otherwise at checkout.

  • Return Shipping Costs: If a defect is confirmed by our support team within the 30-day period, instructions for return or replacement will be provided via email.

5. WARRANTY LIMITATIONS

  • 30-Day Limited Guarantee: KidyPhone provides a 30-day limited functional warranty covering manufacturing defects from the date of delivery.

  • No Extended Guarantee: Except for the aforementioned 30-day defect guarantee, no further express or implied warranties (including commercial guarantees beyond 30 days) are provided with the purchase of the device, unless mandatory statutory rights under local legislation strictly apply.

6. INTERNATIONAL CUSTOMS, DUTIES & LOCAL LAWS

When ordering for delivery outside Spain (including US, UK, CA, AU, EU, and Switzerland):

  • Customers are responsible for ensuring that the device complies with local telecommunication regulations and carrier network frequencies (e.g., 2G/3G/4G/5G compatibility with local SIM cards).

  • Any import duties, taxes, or local customs fees incurred upon arrival in the destination country are the sole responsibility of the customer.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, KidyPhone shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the misuse or inability to use our products or services.

8. GOVERNING LAW & DISPUTE RESOLUTION

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of Spain, without prejudice to any mandatory rights or protections granted to consumers under the local consumer laws of their country of residence.
